There are two types of spousal support that may be awarded by the court.
Interim spousal support may be awarded during a separation or divorce to provide one spouse with sufficient income to maintain an adequate lifestyle. Permanent spousal support is any support that is paid after the marriage is terminated. This permanent support is paid until the court issues a ruling to change the obligation.
The factors that a court will consider when determining the level of spousal support include:
- Income and assets of each spouse
- Earning capacity of each spouse
- Ability to acquire appropriate education, training and employment opportunities
- Health and age of the spouses
- Obligations to support and care for children
- Other financial obligations and relevant circumstances
Support is typically paid on a monthly basis, but is may also be awarded in a lump sum if an arrangement is agreed upon by the parties.
